Suspect in Danby murder case can remain free on bail

MONTPELIER, Vt. (WCAX) – One of the suspects connected to a 2022 murder in Danby can remain free on bail, according to a ruling by the Vermont Supreme Court.

Vermont authorities Monday lost an appeal in the case of Shawn Bulson, one of three suspects police say is connected to the murder of Isaiah Rodriguez, 17, of Springfield, Massachusetts.

Vermont State Police last month arrested the 28-year-old Bulson, along with Ashley Wicks, 32, both of Bennington, on charges of being accessories after the fact to the deadly shooting. Both pleaded not guilty and a judge released him on $5,000 bail.

Prosecutors argued that because Bulson was an accessory to first-degree murder, a violent felony, and that he should be held pending a weight of evidence hearing. But the justices said the charges against him were not a “qualifying crime” and that the law says he cannot be held liable for the violent acts committed by another person.

Police earlier this month also arrested a third person, Elijah Johnson, 22, of Manchester, who they charged with conspiracy to commit murder.

Investigators say the deadly shooting happened after a fight among a group of people over drug trafficking and stolen firearms.
